BeyondBMI Membership and Clinical Services Terms
These Terms explain the basis on which BeyondBMI provides clinical assessments, treatment programmes, memberships, digital services and related support. Please read these Terms carefully before purchasing or using a BeyondBMI service.

Important information
BeyondBMI provides specialist obesity and metabolic health services. BeyondBMI:
- is not an emergency medical service;
- does not replace your general practitioner or other routine healthcare providers;
- does not guarantee that any medicine will be prescribed;
- does not guarantee that a particular medicine, dose or treatment will be suitable for you;
- does not guarantee a particular amount or rate of weight loss; and
- may require you to attend clinical reviews or complete monitoring before treatment can begin or continue.
If you require urgent medical assistance, call 999 or 112, contact your GP, attend an emergency department or use another appropriate urgent medical service.
1. About BeyondBMI
1.1 BeyondBMI is the trading name of Privamed Limited, an Irish company registered under company number 721679, with its registered office at Unit 6E, Nutgrove Office Park, Rathfarnham, Dublin 14, Ireland.
1.2 In these Terms:
- “BeyondBMI”, “we”, “us” or “our” means Privamed Limited trading as BeyondBMI.
- “you” or “your” means the individual purchasing or receiving the Services.
- “Member” means a person who has purchased or enrolled in a BeyondBMI Product.
- “Clinician” means a doctor, nurse, dietitian, psychologist or other regulated healthcare professional providing services through BeyondBMI.
- “Clinical Care Team” means the Clinicians appointed by BeyondBMI to assess, monitor and respond to appropriate treatment-related questions.
- “Care Team” means the Clinical Care Team together with health coaches, care coordinators, support staff and other people involved in delivering the Services.
- “Product” means the BeyondBMI assessment, programme, membership or service you purchase.
- “Product Schedule” means the description of the relevant Product in Schedule 1.
- “Services” means the clinical, programme, support, digital and related services included in your Product.
- “Platform” means the BeyondBMI website, web application, member portal, community and any associated digital systems or related services.
- “Payment Confirmation” means the receipt, payment page or electronic record confirming successful payment for a Product.
- “Business Day” means Monday to Friday, excluding Irish public holidays.
- “Terms” means these Membership and Clinical Services Terms, the Product Schedule, the Payment Confirmation and any policy expressly incorporated into these Terms.
1.3 Clinical decisions are made independently by appropriately registered Clinicians in accordance with their professional obligations. Nothing in these Terms requires a Clinician to prescribe or continue treatment where they consider that doing so would be unsafe, inappropriate or contrary to their professional judgement.
2. How these Terms apply
2.1 These Terms apply when you:
- purchase a BeyondBMI assessment, programme or membership;
- create a BeyondBMI account;
- attend a BeyondBMI consultation;
- use the BeyondBMI Platform or related services;
- receive support from the Care Team; or
- otherwise use the Services.
2.2 Your contract with BeyondBMI is formed when:
- you accept these Terms;
- you select the relevant Product; and
- payment is successfully processed or another agreed payment arrangement is confirmed.
2.3 The Product selected at the point of payment, the applicable Product Schedule and your Payment Confirmation describe the Product you have purchased.
2.4 If there is a conflict between documents, the following order applies:
1. the applicable Product Schedule;
2. these Terms;
3. any policy expressly incorporated into these Terms;
4. the product information displayed at the point of payment; and
5. general information on the BeyondBMI website.
2.5 Marketing material, sales conversations and website descriptions do not amend these Terms unless BeyondBMI expressly confirms the change in writing. Nothing in this clause limits any right you have where you reasonably relied on a representation made by or on behalf of BeyondBMI.
2.6 You must be at least 18 years old and legally capable of entering into a contract.
2.7 Services are currently available only to people who:
- are resident in the Republic of Ireland;
- are physically located in the Republic of Ireland when receiving Clinical Services; and
- meet any applicable clinical and service eligibility requirements.
2.8 You must tell us immediately if your residency or location changes.
3. The nature of the Services
3.1 BeyondBMI is a specialist, remote obesity and metabolic health service.
3.2 Depending on the Product purchased, the Services may include:
- medical assessments;
- medical reviews;
- prescribing and prescription management;
- nursing support;
- dietetic consultations;
- health coaching;
- treatment monitoring;
- digital educational programmes, seminars and resources;
- tracking tools;
- community access;
- care coordination;
- appointment reminders;
- pharmacy liaison relating to a prescription, where clinically or operationally necessary; and
- documentation relating to the Services.
3.3 Not every Product includes every Service. You are entitled only to the Services expressly identified in the applicable Product Schedule and at the point of payment.
3.4 The inclusion of access to a Clinician does not mean that you have unlimited appointments with that Clinician unless the Product Schedule expressly says so.
3.5 Services described as “on demand”, “asynchronous”, “message-based” or “support” remain subject to:
- the scope of the relevant professional service;
- reasonable and appropriate use;
- clinical prioritisation;
- published operating hours;
- staff availability;
- the need for an appointment where a matter cannot safely be managed by message; and
- these Terms.
3.6 BeyondBMI is not a general GP service. We do not provide comprehensive primary care, routine management of unrelated medical conditions or emergency care.
3.7 You must continue to have access to a GP and any other healthcare professionals appropriate to your needs.
4. Products
4.1 The Products currently offered by BeyondBMI are described in Schedule 1. Products, prices, entry conditions and service structures may change from time to time in accordance with section 31.
4.2 A Product name does not, by itself, define what is included. The applicable Product Schedule determines the Services, duration, price, entry conditions and material exclusions.
4.3 A Product may have entry conditions, including:
- completion of an initial assessment;
- completion of an earlier programme phase;
- clinical stability;
- availability only to existing Members;
- availability only by invitation or clinical approval;
- payment of outstanding fees; or
- completion of an additional suitability assessment.
4.4 Purchasing one Product does not guarantee acceptance into another Product.
4.5 BeyondBMI may recommend a Product based on your stated needs. The recommendation is intended to help you understand the available options and does not guarantee clinical suitability.
4.6 A recommendation to purchase a higher-support Product does not replace a clinical referral or clinical escalation. Where your needs fall outside BeyondBMI’s scope, a Clinician may recommend that you seek care from an appropriate external service.
5. Clinical eligibility
5.1 Payment for a Product does not guarantee:
- acceptance for treatment;
- a diagnosis;
- the issue of a prescription;
- the prescription of a particular medicine;
- a particular dose;
- an increase in dose;
- continued prescribing;
- access to medication; or
- a particular clinical outcome.
5.2 A Clinician will determine whether a treatment is appropriate based on factors including:
- your medical history;
- current and previous medication;
- allergies;
- weight and other health information;
- risk factors;
- examination or visual assessment where applicable;
- test results;
- information from your GP or other healthcare providers;
- your engagement with monitoring;
- applicable clinical guidance; and
- the Clinician’s professional judgement.
5.3 A Clinician may:
- request further information;
- request identification;
- require blood tests or other investigations;
- contact or request information from your GP with your consent;
- recommend an in-person assessment;
- decline to prescribe;
- postpone treatment;
- change or reduce a dose;
- pause treatment;
- discontinue treatment;
- refer you to another healthcare provider; or
- decide that remote care is not appropriate.
5.4 A clinical decision not to prescribe, or not to prescribe the medicine or dose you requested, is not evidence that the assessment was not properly provided.
5.5 Any refund following a finding of clinical ineligibility will be determined by the applicable Product Schedule, Schedule 3, the Services already supplied and your statutory rights.
- the applicable Product Schedule;
- the Cancellation and Refund Policy;
- the Services already supplied; and
- your statutory rights.
6. Multidisciplinary review and clinical escalation
6.1 BeyondBMI operates a multidisciplinary model in which relevant members of the Care Team may coordinate your care, discuss appropriate treatment issues and share relevant clinical information for the purposes of safe and effective care.
6.2 Where a query, side effect, treatment response or other concern requires additional expertise, the Care Team may escalate the matter to a more appropriate or more senior Clinician.
6.3 An escalation may include review by:
- a nurse or senior nurse;
- a prescribing doctor or senior doctor;
- a dietitian;
- a health coach acting within their scope;
- an internal multidisciplinary case review; or
- an external healthcare provider where the required care is outside BeyondBMI’s scope.
6.4 Clinical escalation is based on clinical need, urgency, complexity, professional scope and available information. A Member does not have an automatic right to a review by a named individual or to an extra appointment solely because an escalation has been requested.
6.5 An escalation may result in further questions, an additional assessment, a change to treatment, a pause in treatment, referral to a GP or specialist, or direction to urgent or emergency care.
6.6 Multidisciplinary review is not an emergency service. If your condition may be serious or rapidly worsening, follow section 33 rather than waiting for an internal escalation.
7. Your responsibility to provide accurate information
7.1 You must personally complete all medical questionnaires, consent forms and assessments unless BeyondBMI has expressly agreed to reasonable assistance being provided.
7.2 You must give complete, accurate and current information.
7.3 You must not:
- conceal medical information;
- provide false measurements;
- submit another person’s identification;
- allow another person to impersonate you;
- ask another person to attend a consultation in your place;
- submit altered medical documents;
- obtain a prescription for another person; or
- use another Member’s account.
7.4 You must tell the Clinical Care Team promptly about any material change, including:
- a new diagnosis;
- a new medicine or supplement;
- a change in dose prescribed by another healthcare provider;
- an allergy or adverse reaction;
- hospital attendance or admission;
- significant side effects;
- pregnancy, suspected pregnancy or plans to become pregnant;
- breastfeeding;
- planned surgery;
- significant mental-health concerns;
- disordered eating or eating-disorder symptoms;
- material weight change;
- a decision to stop or change treatment; or
- any other information that may affect your care.
7.5 Failure to provide accurate information may make remote treatment unsafe. BeyondBMI may pause or end Clinical Services where important information is missing, inaccurate or misleading.
7.6 You remain responsible for following the instructions provided by your Clinician and pharmacist.
8. Identity and verification
8.1 You must complete any identity, age, address, residency or fraud-prevention checks reasonably required by BeyondBMI.
8.2 Verification may include:
- photographic identification;
- proof of address;
- a live video check;
- comparison of identification with your appearance;
- confirmation of your date of birth;
- confirmation of your registered email or telephone number; and
- checks performed by an approved third-party provider.
8.3 We may delay appointments, prescriptions or account access until verification is completed.
8.4 If verification cannot be completed, BeyondBMI may cancel or suspend the relevant Service. Any refund will depend on the Services already provided and the applicable Product Schedule.
9. Consultations and remote care
9.1 BeyondBMI primarily delivers Clinical Services remotely.
9.2 Consultations may take place by:
- secure video call;
- telephone, where permitted by the relevant Product and considered clinically appropriate;
- secure asynchronous messaging; or
- another approved remote-care format.
9.3 Initial medical assessments are normally conducted by live video. A different format may be used only where the Clinician considers it clinically appropriate and consistent with BeyondBMI’s clinical governance requirements.
9.4 all clinical appointments are video consultations. Exceptions are phone calls if any party has technical issues with connecting, then clinician rings or asks to reschedule for another time.
9.5 If a Clinician cannot adequately assess you remotely, they may:
- end or postpone the consultation;
- ask you to book a video consultation;
- ask you to see your GP;
- refer you to another service; or
- decline to prescribe.
9.6 You must attend consultations from a private, safe and suitable location.
9.7 You must not attend a consultation while driving or operating machinery.
9.8 You must not record a consultation without the prior agreement of everyone participating.
9.9 BeyondBMI may record a consultation only where:
- this is lawful;
- you have been appropriately informed; and
- any required consent has been obtained.
9.10 BeyondBMI may use an approved transcription or artificial-intelligence-assisted documentation tool to create a draft note or summary of a consultation. Where such a tool is used:
- you will be informed before or at the start of the consultation;
- the tool will support documentation and will not make an independent prescribing or treatment decision;
- the Clinician remains responsible for checking, correcting and approving the final clinical record;
- the processing will be governed by BeyondBMI’s Privacy Policy and applicable data-protection requirements; and
- where consent is legally required for recording or processing, it will be obtained before use.
9.11 You are responsible for ensuring that you have:
- a suitable device;
- a reliable internet or telephone connection;
- a working camera and microphone where video is required (camera and microphone set to allowed on your device settings);
- a private environment; and
- access to the Platform.
9.12 If a consultation cannot proceed because of a technical failure:
- the Clinician will decide whether it can safely continue in another format;
- BeyondBMI may ask you to reschedule the appointment;
- the appointment will not normally be treated as used where the failure was caused by BeyondBMI’s systems; and
- Schedule 2 will apply where the failure relates to your device, connection or failure to prepare.
10. Appointments
10.1 Appointment entitlements are set out in your Product Schedule.
10.2 Appointment frequency may be described by:
- calendar month;
- billing month;
- programme month;
- treatment milestone; or
- clinical need.
10.3 The Product Schedule must state which definition applies.
10.4 Appointments are subject to:
- clinician availability;
- appropriate appointment spacing;
- the Member completing required forms or monitoring;
- clinical priority;
- reasonable booking windows; and
- any eligibility or payment requirement.
10.5 BeyondBMI does not guarantee:
- an appointment with a particular Clinician;
- an appointment on a particular date or at a particular time;
- permanent continuity with the same Clinician; or
- immediate availability.
10.6 We will make reasonable efforts to offer included appointments within the relevant Product period.
10.7 BeyondBMI may substitute another appropriately qualified team member where the original team member is unavailable. We will inform you accordingly if there is a change of clinician with as much notice as possible
10.8 Where BeyondBMI cancels an appointment, we will offer a replacement appointment within a reasonable period.
10.9 The detailed appointment rules are in Schedule 2.
11. Rescheduling, late attendance and non-attendance
11.1 You may reschedule an appointment by giving at least 24 hours’ notice, unless a Product Schedule provides a different period.
11.2 Where sufficient notice is provided, the appointment will normally be returned to your available entitlement, provided it can still be taken within the applicable Product period.
11.3 Where you cancel with less than the required notice, the appointment may:
- be treated as used;
- be subject to a rescheduling fee; or
- require a new payment,
as set out in the applicable Product Schedule or Schedule 2.
11.4 If you do not attend:
- the appointment may be treated as used;
- BeyondBMI may offer one discretionary free reschedule within the same Product period;
- a further appointment may require payment; and
- repeated non-attendance may result in a clinical engagement review.
11.5 Repeated missed appointments and late cancellations reduce the availability of Clinician time for other Members. Where there is a repeated pattern, BeyondBMI may, after reasonable attempts to contact you:
- restrict direct or self-service appointment booking;
- require appointments to be booked through the Support Team;
- require advance payment for replacement or additional appointments;
- limit access to non-urgent appointments until an engagement review is completed;
- suspend the Product; or
- end the Product where continued participation is not operationally or clinically appropriate.
11.6 Any restriction, suspension or termination under clause 11.5 will take account of clinical safety, reasonable notice, continuity of care and your statutory rights.
11.7 Product-specific no-show rules, including the €89 Assessment rule, are set out in Schedule 1 and Schedule 2.
11.8 If you arrive late:
- the appointment may be shortened;
- the Clinician may decide there is insufficient time to proceed safely;
- the appointment may need to be rescheduled; and
- the appointment may still be treated as used.
11.9 Unless a Product Schedule states otherwise, unused appointments expire at the end of the relevant billing, programme or entitlement period.
11.10 Unless expressly stated otherwise:
- unused appointments have no cash value;
- appointments cannot be transferred to another person;
- an appointment with one professional cannot be exchanged for an appointment with another professional; and
- unused appointments are not refundable merely because you chose not to book or attend them.
11.11 This section does not affect your rights where BeyondBMI failed to make an included Service reasonably available.
12. Required reviews, monitoring and clinical inactivity
12.1 Safe prescribing may require periodic reviews, questionnaires, measurements, test results or other monitoring.
12.2 You must participate in monitoring reasonably required by your Clinician.
12.3 Monitoring may include:
- weight;
- height;
- waist measurement;
- blood pressure;
- pulse;
- treatment adherence;
- dose;
- side effects;
- nutrition;
- mental wellbeing;
- eating behaviour;
- medication response;
- blood tests; and
- confirmation of other medicines.
12.4 Your Product may include a standard review schedule, but a Clinician may require additional or earlier reviews.
12.5 A standard appointment frequency does not prevent a Clinician from deciding that a review is required before issuing or renewing a prescription.
12.6 If you do not complete required monitoring or do not follow the required cadence of reviews, BeyondBMI may:
- withhold or decline to renew a prescription;
- decline a dose increase;
- postpone a review;
- restrict direct appointment booking;
- require contact through the Support Team;
- pause treatment;
- classify the account as clinically inactive; or
- discontinue Clinical Services where continuing would be unsafe or inappropriate.
12.7 Where a required follow-up becomes overdue, BeyondBMI may contact you by telephone, email, SMS or Platform message to support re-engagement and safe continuation of care.
12.8 If a required clinical follow-up remains overdue for 180 days or more, BeyondBMI may classify your account as inactive.
12.9 Once the account is classified as inactive, BeyondBMI will normally make reasonable contact attempts over a period of at least three weeks and issue a final notice before closing the account or ending the Product.
12.10 If you do not book or complete the required follow-up by the date stated in the final notice, BeyondBMI may close the account or end the Product at the end of the stated notice period.
12.11 During a period of clinical inactivity, BeyondBMI may restrict appointment booking and may not issue or renew a prescription until an appropriate clinical review has been completed.
12.12 Closure for inactivity does not prevent you from applying to return, but return is subject to section 26 and may require a new assessment.
13. Clinical Care Team and Support Team
13.1 The applicable Product Schedule will state whether ongoing Clinical Care Team support is included.
13.2 Clinical Care Team support is intended for appropriate questions relating to your BeyondBMI treatment, including:
- treatment administration;
- common side effects;
- medication concerns;
- adherence;
- prescription queries;
- questions arising between scheduled appointments; and
- identifying when a further clinical assessment or escalation may be required.
13.3 It does not include:
- emergency care;
- 24-hour monitoring;
- general GP services;
- medical advice unrelated to BeyondBMI treatment;
- unlimited doctor consultations;
- guaranteed immediate responses;
- administrative support outside the stated channels; or
- treatment of conditions outside BeyondBMI’s scope.
13.4 Support is available through secure message, email, telephone and the web portal during operating hours: Monday to Friday, 8.00 a.m. to 4.00 p.m., excluding Irish public holidays.
13.5 Our target response times are:
- a first response within four Business Hours where triage identifies a potentially urgent but non-emergency clinical query; and
- a first or initial response within two Business Days for routine clinical, administrative or operational queries.
13.6 Response time is measured from when the query is received through an approved channel during operating hours.
13.7 A response-time target is not an emergency-care guarantee. The Clinical Care Team will assess and prioritise queries according to clinical urgency, risk, complexity and available information.
13.8 The Support Team may:
- provide general administrative guidance;
- ask you for further information;
- route a query to a nurse or doctor;
- help arrange an appointment;
- advise you to contact your pharmacist or GP; or
- direct you to urgent or emergency care.
13.9 The Clinical Care Team may provide clinical guidance, request further information, escalate a matter under section 6, arrange a review or direct you to another appropriate service.
13.10 “Ongoing clinical support” means that there is no fixed numerical cap on reasonable treatment-related messages. It does not mean unlimited appointments, continuous monitoring or unrestricted access to an individual Clinician.
13.11 BeyondBMI may introduce reasonable communication boundaries where messages or conduct are:
- repetitive;
- unrelated to the Services;
- abusive, threatening or discriminatory;
- excessive to the point that safe and fair service delivery is affected;
- submitted through inappropriate channels; or
- better addressed in an appointment.
13.12 Communication boundaries may include:
- requiring use of one approved contact channel;
- appointing a single point of contact;
- combining repeated queries into one response;
- limiting non-urgent contact to reasonable intervals;
- restricting access to community or non-essential features; or
- suspending or ending Services for serious or persistent misconduct.
13.13 Any communication boundary will take account of fairness to other Members, staff safety, clinical safety, continuity of care and your statutory rights.
14. Dietitian services
14.1 Dietitian services are included only where stated in your Product Schedule.
14.2 Dietitian services may include:
- nutritional assessment;
- support with nutritional adequacy;
- eating while using weight-management medication;
- support with common gastrointestinal side effects;
- practical dietary guidance;
- food-related behaviour support within professional scope;
- nutritional goal setting; and
- coordination with the Clinical Care Team.
14.3 Dietitian services do not guarantee:
- a prescribed meal plan;
- a particular weight result;
- treatment of every medical or gastrointestinal condition;
- specialist eating-disorder treatment; or
- support outside the dietitian’s professional scope.
14.4 The dietitian may recommend additional medical assessment or referral to an external specialist.
14.5 Where a personalised plan or written follow-up is included, the Product Schedule must state:
- what will be provided;
- the expected delivery timeframe; and
- whether later updates are included.
15. Health coaching
15.1 Health coaching is included only where stated in your Product Schedule.
15.2 Health coaching may support:
- behaviour change;
- habit development;
- practical goal setting;
- motivation;
- self-monitoring;
- physical activity within appropriate limits;
- consistency;
- treatment adherence; and
- identifying barriers to progress.
15.3 Health coaches do not:
- diagnose medical or mental-health conditions;
- prescribe or change medication;
- provide emergency care;
- replace a doctor, dietitian or psychologist;
- provide psychotherapy unless separately qualified and contracted to do so; or
- give advice outside their professional scope.
15.4 A health coach may share relevant information with the Clinical Care Team where necessary for coordinated and safe care.
15.5 A health coach may escalate a concern or recommend that you speak with a Clinician or external healthcare professional.
16. Digital programme and educational content
16.1 Your Product may include access to digital educational content, programmes, tracking tools and resources.
16.2 Digital content may include recorded or live seminars and may cover:
- medication education;
- treatment expectations;
- nutrition;
- physical activity;
- behaviour change;
- psychology;
- side-effect management;
- treatment adherence;
- weight maintenance; and
16.3 Unless a Clinician expressly tells you otherwise, digital content is general educational information and is not individual medical advice.
16.4 Digital content does not replace:
- a clinical assessment;
- an individual diagnosis;
- personalised prescribing advice;
- emergency care; or
- a recommendation made by your Clinician.
16.5 Content may not be suitable for every Member. Contact the Clinical Care Team where you are uncertain whether information applies to you.
16.6 BeyondBMI may update, replace or retire content to:
- reflect updated evidence;
- improve clarity;
- correct an error;
- meet legal or professional requirements;
- improve the programme; or
- address safety concerns.
16.7 We will not materially reduce the core paid Services during a fixed Product term without:
- a valid reason;
- reasonable notice where possible;
- an appropriate replacement; or
- an appropriate remedy where required.
16.8 Your access to digital content normally ends when the relevant Product ends, unless otherwise stated.
16.9 You may use the content only for your personal, non-commercial use.
16.10 You must not copy, distribute, sell, publish, record, scrape or reproduce BeyondBMI content without written permission.
17. Community
17.1 Community access is included only where stated in your Product Schedule.
17.2 Participation is optional unless the Product Schedule expressly provides otherwise.
17.3 The community is intended for peer support and general discussion. It is not a clinical-support or emergency channel.
17.4 Information posted by Members:
- is not verified medical advice;
- may not be accurate;
- should not be used to make treatment decisions; and
- does not represent BeyondBMI’s views.
17.5 Members must not:
- offer to sell, exchange or share prescription medicine;
- advise another Member to start, stop or change a medicine or dose;
- encourage unsafe restriction, purging, starvation or extreme exercise;
- impersonate a Clinician;
- post another person’s personal or medical information;
- share screenshots or community content outside the community;
- harass, shame, threaten or discriminate against another person;
- make misleading treatment claims;
- advertise products or services without permission;
- post unlawful or infringing content; or
- use the community for an emergency.
17.6 BeyondBMI may moderate, edit, move or remove content and may restrict a Member’s community access.
17.7 Moderation is not continuous or real-time. BeyondBMI cannot guarantee that every inappropriate post will be identified immediately.
17.8 A Member should report concerning content through the approved reporting route.
17.9 BeyondBMI may escalate content to the Clinical Care Team or external services where there is a serious clinical, safeguarding or legal concern.
17.10 Ending community access does not necessarily end Clinical Services, but serious conduct may result in broader suspension or termination under section 30 .
18. Prescriptions
18.1 A prescription will be issued only where an authorised prescriber considers it clinically appropriate.
18.2 A prescription may specify:
- a particular medicine;
- dose;
- quantity;
- duration;
- titration schedule;
- repeat conditions; and
- required review date.
18.3 You must use medication only as prescribed.
18.4 You must not:
- increase or decrease your dose without clinical advice;
- use another person’s medicine;
- give your medicine to another person;
- obtain overlapping prescriptions without disclosure;
- combine treatment with another weight-management medicine without approval;
- falsify information to obtain medicine;
- continue using medicine after being told to stop; or
- use a prescription after it has been withdrawn or superseded.
18.5 A prescription may be changed, paused, declined or discontinued where:
- the medicine is not effective or tolerated;
- side effects create concern;
- monitoring has not been completed;
- you have not attended a required review;
- relevant medical information has changed;
- you have obtained treatment elsewhere;
- continued remote prescribing is inappropriate; or
- the prescriber considers it clinically necessary.
18.6 Prescription renewal is not automatic merely because you have paid a membership fee.
18.7 You are responsible for requesting or completing any required renewal step in sufficient time.
18.8 BeyondBMI does not guarantee that a prescription can be issued on the same day.
19. Medication cost, pharmacy and collection or delivery
19.1 BeyondBMI does not sell, supply, dispense or deliver medication. BeyondBMI’s role is limited to assessment, prescribing and prescription management where clinically appropriate.
19.2 Unless the applicable Product Schedule expressly states otherwise, the cost of medication is not included in the Product fee.
19.3 You are responsible for selecting an independent pharmacy and for deciding whether to collect medication or use any delivery service offered by that pharmacy.
19.4 You contact directly with the pharmacy for dispensing, medication payment, collection and any delivery arrangements.
19.5 The independent pharmacy is responsible for:
- dispensing;
- its own identity, safety and pharmacy checks;
- medicine labelling;
- pharmacy advice;
- stock;
- the price charged for medication;
- collection or delivery arrangements; and
- responding to dispensing or delivery errors.
19.6 A pharmacy may:
- request identification or additional information;
- contact you;
- contact the prescriber;
- decline to dispense;
- substitute a product where legally and clinically permitted;
- delay dispensing pending clarification; or
- apply its own delivery or collection terms.
19.7 BeyondBMI does not guarantee:
- pharmacy stock;
- the price charged by a pharmacy;
- availability of a particular brand;
- collection or delivery on a particular date;
- uninterrupted medication supply; or
- that every pharmacy will accept a particular form of prescription.
19.8 Medication prices and pharmacy processes may change independently of BeyondBMI.
19.9 If your medicine is unavailable, contact the pharmacy and BeyondBMI promptly. A Clinician may consider an alternative, but no alternative medicine, brand or dose is guaranteed.
19.10 A pharmacy delay, stock shortage or delivery failure does not automatically mean that a consultation or other BeyondBMI Service was not supplied.
19.11 Nothing in this section limits any rights you have against the pharmacy or BeyondBMI under applicable law.
20. Insurance, tax and reimbursement documents
20.1 BeyondBMI may provide invoices, receipts or clinical documentation to support an insurance or tax-relief claim.
20.2 BeyondBMI does not guarantee:
- that an insurer will reimburse you;
- the amount an insurer will reimburse;
- that a Product qualifies for tax relief;
- the timing of reimbursement; or
- that an insurer will accept a particular document.
20.3 You are responsible for checking your policy and eligibility directly with your insurer or relevant authority.
20.4 Any estimate of potential reimbursement is illustrative unless expressly confirmed in writing by the insurer.
21. Fees, VAT and payment
21.1 The price of your Product is shown before you pay and is recorded in your Payment Confirmation.
21.2 Prices are in euro. Qualifying medical care services are treated as exempt from VAT where the legal exemption applies. Where a Product includes any element on which VAT is chargeable, the price shown will include the applicable VAT unless clearly stated otherwise.
21.3 You authorise BeyondBMI and its payment provider to charge the agreed payment method.
21.4 Depending on the Product, payment may be:
- a single payment;
- a fixed programme fee paid upfront;
- a fixed programme fee paid in instalments;
- a recurring monthly membership fee; or
- a separate fee for an additional appointment or service.
21.5 BeyondBMI may use a third-party payment processor such as Stripe. The processor’s terms may also apply to payment processing.
21.6 BeyondBMI does not store full payment-card details where these are processed by an authorised payment provider.
21.7 You must keep your payment details current.
21.8 You must contact us promptly if:
- a payment appears incorrect;
- you believe a payment was unauthorised;
- your payment method has changed; or
- you expect difficulty making a scheduled payment.
21.9 We may retry a failed payment and contact you about the failure.
21.10 We will not impose an additional payment or charge unless you have been clearly informed and have agreed to it, except for amounts already due under an agreed fixed-term payment plan.
22. Failed payments and overdue accounts
22.1 Where a payment fails, BeyondBMI or its payment provider may:
- notify you;
- retry the payment;
- ask you to update your payment method;
- allow a limited grace period;
- mark the subscription or invoice as overdue;
- temporarily restrict non-essential access; or
- end the Product in accordance with these Terms.
22.2 Unless a Product Schedule states otherwise, the payment provider may make up to four payment retries during a period of approximately one month.
22.3 While an account is overdue, BeyondBMI may restrict access to direct booking, non-urgent appointments, digital content or other non-essential Services.
22.4 BeyondBMI may contact you by email, SMS, telephone or Platform message to request payment, updated payment details or confirmation of whether you intend to continue.
22.5 We will take reasonable steps to avoid an unsafe interruption of active Clinical Services. Where clinically appropriate, BeyondBMI may allow temporary, limited access to a final or necessary follow-up appointment. Any temporary access is discretionary and does not waive the amount owed.
22.6 BeyondBMI may withhold a new prescription, dose increase or non-urgent appointment while payment remains outstanding, where clinically and legally appropriate.
22.7 BeyondBMI may require all outstanding fees to be paid before full access, self-booking or a Product is restored.
22.8 If payment remains unresolved after the applicable retry and contact period, BeyondBMI may cancel the subscription or fixed-term access and begin the safe offboarding process.
22.9 Ending access for non-payment does not remove your obligation to pay amounts already due under a fixed-term agreement.
22.10 The more detailed payment-failure and account-inactivity rules are set out in Schedule 4.
23. Fixed-term programmes
23.1 A fixed-term programme lasts for the duration stated in the applicable Product Schedule and has the start date stated at the point of payment.
23.2 A fixed-term programme may be paid:
- in one upfront payment; or
- by instalments that form part of the total fixed programme fee.
23.3 Unless the Product Schedule states otherwise, installments are not separate monthly memberships. They are scheduled payments of the fixed programme price.
23.4 The programme end date may be adjusted where:
- BeyondBMI reschedules an appointment;
- a Clinician approves a clinical pause;
- you experience a significant clinical issue;
- an agreed temporary extension applies; or
- BeyondBMI confirms a change in writing.
23.5 Where the Product Schedule states that a fixed-term programme converts to a recurring membership, the conversion, Product, price and cancellation arrangement must be clearly disclosed before the original purchase.
23.6 The 90-Day Programme is intended to convert to Premium at the end of the programme where the Member agreed to that conversion at purchase. BeyondBMI will provide a reminder before the first Premium payment.
23.7 A Member may request review for Core or another available Product before conversion. A requested change is subject to the Product’s entry conditions, clinical appropriateness and availability and is not guaranteed.
23.8 If you do not want the recurring membership to begin, you must cancel or request an alternative in accordance with the notice provided before conversion.
23.9 Any upfront-payment discount applies only where the full programme fee is paid upfront. The standard price, discounted price, instalments and saving must be shown consistently before payment.
24. Recurring memberships
24.1 Core and Premium are recurring monthly memberships unless the Product Schedule states otherwise.
24.2 The first membership period begins on activation date.
24.3 Your membership renews automatically each month until cancelled.
24.4 The renewal payment will normally be taken on the same numerical date each month.
24.5 Where a month does not contain that date, payment may be taken on the final day of the month.
24.6 Membership fees pay for access to the package of Services during the relevant period. They are not calculated solely by the number of appointments you use.
24.7 Not using included Service does not entitle you to a refund or credit.
24.8 This does not affect your rights where BeyondBMI failed to provide reasonable access to a material included Service.
24.9 A Product may be restricted to:
- Members who have completed the 90-Day Programme;
- Members who are clinically stable;
- existing Members;
- Members invited by the Clinical Care Team; or
- another defined group.
24.10 The Product Schedule must clearly state any entry condition.
24.11 You may request a change to your monthly payment date. A change is subject to operational approval, may require a proportionate bridging payment or adjustment and is not guaranteed until confirmed in writing.
25. Upgrades and downgrades
25.1 You may request to change membership by contacting support@beyondbmi.ie.
25.2 A requested change is subject to:
- the Product being available;
- any entry requirements;
- payment of the applicable fee and any overdue amount;
- clinical review where required; and
- these Terms.
25.3 Unless otherwise agreed:
- an upgrade takes effect on the next billing date;
- a downgrade takes effect on the next billing date;
- no retrospective refund is provided for the existing membership period;
- access to removed Services ends when the downgrade takes effect; and
- Services already used are not converted into credit.
25.4 An immediate upgrade may be offered at BeyondBMI’s discretion and may require a proportionate additional payment.
25.5 An appointment booked under a higher membership:
- may be attended if it occurs before the downgrade date; and
- may be cancelled if it occurs after the downgrade date unless purchased separately.
25.6 A Member may not repeatedly switch Products to obtain appointments or Services outside the entitlement for which the applicable fee has been paid.
25.7 If you leave a legacy, discounted or promotional Product, you may not be able to return to the previous Product or price.
25.8 A Clinician may recommend that you move to a Product with additional support. You retain the choice whether to purchase the commercial Product.
25.9 Declining an optional upgrade does not remove your entitlement to safe care within the scope of your existing Product.
25.10 If your clinical needs cannot safely be managed within BeyondBMI’s service, a Clinician may recommend or require referral to an appropriate external provider.
25.11 BeyondBMI may require outstanding fees to be paid before a change is processed or access to a previous Product is restored.
26. Cancelling
26.1 You may submit a cancellation request through support@beyondbmi.ie.
26.2 A cancellation request must include sufficient information to identify and verify the correct Member account. BeyondBMI may take proportionate steps to verify your identity before processing the request.
26.3 We aim to acknowledge a cancellation request within one to two Business Days.
26.4 Commercial cancellation does not require you to:
- provide a reason;
- take a retention call;
- speak with a care coordinator;
- accept an alternative Product; or
- complete a clinical exit appointment.
26.5 Because abruptly changing treatment may create clinical risks, BeyondBMI may contact you separately to:
- confirm whether you intend to stop medication;
- provide safety information;
- offer a final clinical review;
- communicate with your GP with appropriate consent;
- explain how to obtain continuing care; or
- provide an appropriate clinical handover.
26.6 Failure to participate in an offered clinical exit review does not invalidate an otherwise valid commercial cancellation request.
26.7 The effective date and financial effect of cancellation depend on the Product and Schedule 3.
26.8 For recurring memberships:
- cancellation takes effect after 30 days’ notice;
- payments falling due during the notice period remain payable;
- access continues until the confirmed end date; and
- no partial refund is normally provided for the final paid period.
26.9 Cancellation of a fixed-term programme is governed by section 23 and Schedule 3.
26.10 Cancelling BeyondBMI does not cancel any dispensing or delivery arrangement already accepted by an independent pharmacy. You must contact the pharmacy separately.
Returning Members
26.11 A former Member may apply to return, but re-entry is not automatic and BeyondBMI does not guarantee return to the same Product, price, programme phase or Clinician.
26.12 Before returning, BeyondBMI may requires:
- payment of outstanding fees;
- a new identity or eligibility check;
- a new initial assessment;
- updated medical information or tests;
- completion of an earlier programme phase;
- enrolment in a Product then available; or
- advance payment or a different payment arrangement.
26.13 BeyondBMI may refuse or place reasonable conditions on re-entry where there has been fraud, abuse, prescription misuse, serious misconduct, repeated non-engagement or a repeated pattern of cancellation and rejoining that BeyondBMI reasonably believes is intended to avoid payment or obtain Services outside the Product rules.
26.14 Any re-entry decision will take account of clinical safety, operational fairness, the circumstances of the previous exit and applicable consumer and equality law.
27. Statutory cancellation and consumer rights
27.1 Nothing in these Terms limits any mandatory right or remedy available to you under Irish law.
27.2 Irish law provides a right to cancel certain contracts entered into online, by telephone or away from business premises. However, the statutory cancellation provisions do not generally apply to contracts for the supply of healthcare as defined under applicable consumer law.
27.3 The €89 Assessment is a healthcare service involving a professional clinical assessment. It does not carry a statutory 14-day change-of-mind cancellation right where it falls within the legal definition of a healthcare contract. Any cancellation or refund available in relation to the €89 Assessment is therefore governed by Schedule 3 and your other mandatory legal rights.
27.4 Where a statutory cancellation right applies to another Product or to part of a Product, the applicable cancellation period will normally be 14 days from the date the contract is concluded.
27.5 Where you ask BeyondBMI to begin supplying a Service during an applicable statutory cancellation period, BeyondBMI may require you to:
expressly request that the Service begins during that period;
acknowledge that you may be required to pay for Services supplied before cancellation; and
acknowledge that the right to cancel may end once the Service has been fully supplied.
27.6 Where you cancel during an applicable statutory cancellation period after the Service has begun but before it has been fully supplied, you may be required to pay a proportionate amount for the Services already supplied, where permitted by law.
27.7 Where a Service has been fully supplied after you expressly requested early commencement and acknowledged that the cancellation right would be lost on full performance, the statutory right to cancel may end.
27.8 The availability and effect of any statutory cancellation right will depend on the nature of the Product and the applicable law.
28. Refunds
28.1 Refunds are determined by:
- the Product purchased;
- the reason for the request;
- the Services already supplied;
- whether an appointment was reserved or attended;
- whether digital or programme access was activated;
- whether BeyondBMI failed to provide an agreed Service;
- the applicable Product Schedule and Schedule 3; and
- your statutory rights.
28.2 Refunds are not automatically due because:
- a Clinician did not prescribe medication;
- a particular medication was not prescribed;
- a requested dose increase was declined;
- medication was unavailable at a pharmacy;
- you did not achieve a particular result;
- you chose not to use an included Service;
- you failed to attend an appointment; or
- you changed your mind after a Service was fully supplied,
except where the applicable Product Schedule expressly provides otherwise or the law requires a refund.
28.3 Where BeyondBMI cancels and cannot reasonably reschedule a material paid Service, we may provide:
- a replacement Service;
- an extension;
- a credit;
- a proportionate refund; or
- another appropriate remedy.
28.4 Any approved refund will normally be made to the original payment method.
28.5 Processing times may depend on the payment provider.
28.6 The €89 Assessment fee is payment for the professional assessment. Unless required by law or stated otherwise in Schedule 3, it is not refunded solely because medication is clinically unsuitable or no prescription is issued.
28.7 For the 90-Day Programme, any statutory cancellation right applies as described in section 27. After any applicable cancellation period has expired, payments already made are not refundable merely because the Member withdraws or does not use the Services, except where required by law, expressly stated in Schedule 3 or BeyondBMI materially fails to provide the programme.
28.8 An upfront discount applies only to an upfront payment. The same cancellation and refund principles apply to the discounted upfront amount, subject to any proportionate calculation required by law.
29. Pausing Services
29.1 A commercial or membership pause is available only in defined circumstances, is assessed case by case and is not guaranteed.
29.2 A clinical pause may be approved only by the Clinical Care Team. A clinical pause is different from a payment failure, informal non-attendance or a Member simply ceasing to use the Services.
29.3 During an approved clinical pause, access to appointments and non-essential Services may be suspended and no membership fee will normally be charged for the approved pause period (maximum of three months once per contract lifetime).
29.4 A Clinician may pause medication or Clinical Services for safety reasons even where a commercial Product remains active.
29.5 When deciding whether to approve a pause, BeyondBMI may consider:
- the clinical reason for the request;
- the anticipated duration;
- whether evidence or further assessment is required;
- whether safe prescription management can continue;
- whether digital access should continue;
- the effect on appointment entitlements;
- the billing date; and
- the need for a review before reactivation.
29.6 A pause will not be treated as accepted until confirmed in writing, including its start date, expected end date and any conditions for reactivation.
29.7 If a Member stops responding or does not complete the agreed reactivation steps, BeyondBMI may treat the account as inactive and apply section 12 and Schedule 4.
30. Suspension or ending Services by BeyondBMI
30.1 BeyondBMI may suspend or end all or part of the Services where:
- payment remains outstanding;
- you do not meet eligibility requirements;
- identity cannot be verified;
- you provide false or materially incomplete information;
- you repeatedly fail to attend required clinical reviews;
- you do not complete required monitoring;
- continued remote treatment is unsafe;
- your needs fall outside BeyondBMI’s scope;
- you misuse medication or prescriptions;
- you threaten or abuse staff or other Members;
- you seriously breach community rules;
- you misuse the Platform;
- you attempt fraud;
- you are no longer located in a jurisdiction we can serve;
- a Clinician considers treatment should end;
- a legal or regulatory requirement prevents continued delivery; or
- the Product is withdrawn and an appropriate transition is provided.
30.2 Where possible and appropriate, we will tell you:
- the reason;
- the effective date;
- any action you can take;
- whether the suspension is temporary;
- how to access your medical information; and
- what follow-up care may be required.
30.3 Immediate suspension may occur where there is:
- a serious safety concern;
- suspected fraud;
- abuse or threats;
- prescription misuse;
- risk to another person; or
- a legal obligation.
30.4 A commercial suspension will be managed separately from clinical continuity-of-care obligations.
30.5 Where treatment ends, BeyondBMI may:
- provide safety information;
- offer a final review;
- recommend GP follow-up;
- provide a clinical summary;
- communicate with another healthcare provider with appropriate authority; and
- explain how records may be accessed.
30.6 Any refund will depend on the circumstances, Services already supplied, the Product Schedule and applicable law.
30.7 BeyondBMI may also restrict or end access where an account remains overdue after the payment-recovery process, or where the account is closed for clinical inactivity under section 12 and Schedule 4.
31. Changes to Products and Services
31.1 BeyondBMI may make changes to:
- delivery processes;
- systems;
- appointment formats;
- content;
- personnel;
- support channels;
- administrative procedures; and
- non-material Product features.
31.2 We may make changes without advance notice where urgently required for:
- clinical safety;
- security;
- legal compliance;
- professional standards;
- medication safety; or
- prevention of fraud or misuse.
31.3 We will provide reasonable advance notice of a material change where possible.
31.4 We will not materially reduce a fixed-term Product without a valid reason and an appropriate remedy.
31.5 For recurring memberships, a material Product change may take effect from a future renewal date.
31.6 Where a material change significantly disadvantages you, you may cancel before the change takes effect without an additional cancellation charge.
31.7 We may change prices by giving at least 30 days’ notice.
31.8 A price change will not apply retrospectively.
31.9 If you do not wish to accept a price increase, you may cancel before the first increased payment.
31.10 Continued use after a properly notified renewal change may be treated as acceptance only to the extent permitted by law.
32. Care Team changes and capacity
32.1 BeyondBMI may change the composition of the Care Team.
32.2 We do not guarantee permanent access to a named Clinician or coach.
32.3 All replacement Clinical Services will be provided by an appropriately qualified person.
32.4 Where a team member is unavailable, we may:
- reassign the appointment;
- reschedule;
- provide another suitable format;
- extend the relevant entitlement period; or
- offer another appropriate remedy.
32.5 Appointment capacity may vary. BeyondBMI will maintain reasonable capacity to provide the Services described in each Product.
32.6 We will not treat permanent lack of capacity as a reason to repeatedly deny an included material Service without remedy.
33. Emergency and urgent concerns
33.1 BeyondBMI is not an emergency service.
33.2 Do not use:
- email;
- the Platform;
- community posts;
- routine support messaging;
- appointment booking; or
- voicemail
for an emergency.
33.3 Call 999 or 112 or attend an emergency department where you have symptoms including:
- difficulty breathing;
- severe allergic reaction;
- chest pain;
- collapse;
- severe abdominal pain;
- persistent vomiting with inability to keep fluids down;
- signs of severe dehydration;
- thoughts of immediate self-harm;
- risk of harm to another person; or
- any other serious or rapidly worsening condition.
33.4 This list is not exhaustive.
33.5 For urgent but non-emergency concerns, contact your GP, out-of-hours GP or another appropriate urgent-care service.
34. Communication
34.1 We may contact you by:
- email;
- SMS;
- telephone;
- secure Platform message;
- push notification;
- letter; or
- another agreed channel.
34.2 You must keep your contact details current.
34.3 You are responsible for checking communications relating to:
- appointments;
- prescriptions;
- clinical monitoring;
- payment;
- Product changes;
- account inactivity; and
- safety information.
34.4 Administrative and clinical communications form part of delivering the Services and are different from optional marketing.
34.5 BeyondBMI may contact you with an important clinical, safety, payment or operational message even where you have opted out of marketing or non-essential communications.
34.6 You may opt out of marketing without opting out of essential service communications.
34.7 Ordinary email and SMS may have security limitations. Do not send urgent or highly sensitive information through an unapproved channel.
35. Your account
35.1 Your account is personal to you.
35.2 You must:
- use a unique password;
- keep your login confidential;
- use reasonable security measures;
- notify us of suspected unauthorised access; and
- log out of shared devices.
35.3 You must not share your account.
35.4 You are responsible for activity on your account unless it results from BeyondBMI’s failure to use reasonable security.
35.5 We may require a password reset or temporarily restrict access where we suspect a security issue.
36. Data protection and medical records
36.1 BeyondBMI processes personal data and health data as described in its Privacy Policy.
36.2 Clinical information may be recorded in your medical record.
36.3 Relevant information may be shared within the Care Team where necessary for:
- direct care;
- clinical safety;
- coordination;
- quality assurance;
- safeguarding; and
- lawful service administration.
36.4 With your consent, we may share relevant information with:
- your GP;
- another healthcare professional;
- a pharmacy;
- a laboratory; or
- another provider involved in your care.
36.5 Information may be disclosed without consent where this is permitted or required by law, including in certain serious safeguarding or safety circumstances.
36.6 You may request access to your personal data or medical records in accordance with applicable law and the Privacy Policy.
36.7 Clinical records will be retained in accordance with applicable law, professional guidance and BeyondBMI's Records Retention Policy. Unless a different period is required, clinical records will normally be retained for the lifetime of the patient and for eight (8) years after death, or for such longer period as may be required for legal, regulatory, safeguarding or medico-legal purposes. Different retention periods may apply to certain categories of records.
36.8 Ending membership does not require BeyondBMI to delete medical records that it is required or permitted to retain.
36.9 Where BeyondBMI uses approved transcription or AI-assisted documentation tools, information about the purposes, legal basis, recipients, retention and safeguards will be provided through the Privacy Policy or a specific notice.
37. Third-party providers
37.1 BeyondBMI may use third parties to support:
- payment;
- appointment booking;
- video consultations;
- electronic health records;
- identity verification;
- communications;
- pharmacy services;
- delivery;
- hosting;
- analytics; and
- the Platform.
37.2 Some third-party services may have their own terms.
37.3 BeyondBMI remains responsible for its own obligations and does not exclude responsibility that cannot lawfully be excluded.
37.4 BeyondBMI is not responsible for a third party’s independent service where the Member contracts directly with that third party, except to the extent that BeyondBMI is legally responsible.
37.5 We may replace a third-party provider where this does not materially reduce your Product.
38. Results and treatment expectations
38.1 People respond differently to obesity treatment.
38.2 Results depend on many factors, including:
- clinical suitability;
- adherence;
- medication tolerance;
- dose;
- biology;
- health conditions;
- nutrition;
- physical activity;
- behaviour;
- treatment duration; and
- circumstances outside BeyondBMI’s control.
38.3 BeyondBMI does not guarantee:
- weight loss;
- a particular percentage of weight loss;
- achievement of a target weight;
- prevention of weight regain;
- elimination of appetite or food noise;
- improvement in a particular medical condition;
- access to medication indefinitely; or
- that treatment will be side-effect free.
38.4 Weight loss may slow or plateau.
38.5 Stopping treatment may be associated with weight regain.
38.6 Information about typical or average outcomes is general information and not a prediction of your personal result.
38.7 Before-and-after stories, reviews and testimonials describe individual experiences and are not guarantees.
39. Complaints and concerns
39.1 You may raise:
- a service complaint;
- a billing complaint;
- a privacy concern;
- a clinical concern; or
- a safeguarding concern.
39.2 Contact details:
- General support: support@beyondbmi.ie
39.3 We aim to acknowledge a formal complaint within 2 Business Days.
39.4 We aim to provide a substantive response within 5 Business Days, although complex clinical matters may require longer.
39.5 Clinical complaints may be reviewed by an appropriate Clinician who was not directly responsible for the matter, where practicable.
39.6 Raising a complaint will not adversely affect your care.
39.7 Nothing in these Terms prevents you from contacting a professional regulator, the Data Protection Commission, the Competition and Consumer Protection Commission or another body with jurisdiction.
40. Intellectual property
40.1 BeyondBMI or its licensors own the intellectual property in:
- the Platform;
- programme materials;
- videos;
- written content;
- designs;
- branding;
- questionnaires;
- tools;
- templates; and
- other proprietary resources.
40.2 You receive a limited, personal, non-exclusive, non-transferable right to use materials included in your Product.
40.3 You may not:
- reproduce materials commercially;
- share paid content outside your household;
- publish recordings;
- scrape content;
- reverse-engineer the Platform;
- remove copyright notices;
- sell access; or
- use the materials to create a competing product.
40.4 You retain ownership of content you submit, but grant BeyondBMI the rights reasonably required to store, display and process that content to provide the Services.
40.5 BeyondBMI will not use an identifiable testimonial, photograph or story for marketing without appropriate permission.
41. Platform availability
41.1 The Platform may occasionally be unavailable because of:
- maintenance;
- updates;
- security work;
- internet outages;
- third-party failures;
- emergency work; or
- circumstances outside our reasonable control.
41.2 We will make reasonable efforts to restore access.
41.3 Planned maintenance likely to cause material disruption will be notified where reasonably possible.
41.4 Where a material digital feature is unavailable for a significant period, we may provide:
- an alternative delivery method;
- an extension;
- a replacement Service;
- a credit; or
- another appropriate remedy.
41.5 You should contact the Clinical Care Team through the alternative route provided where Platform failure affects an important clinical communication.
42. Liability
42.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- wilful misconduct;
- breach of mandatory consumer rights; or
- another liability that cannot legally be excluded.
42.2 BeyondBMI is responsible for providing the Services with the level of skill, care and quality required by applicable law and professional obligations.
42.3 BeyondBMI is not responsible for loss caused by:
- inaccurate or withheld information provided by you;
- failure to follow clinical instructions;
- use of medicine contrary to the prescription;
- use of another person’s medicine;
- unauthorised dose changes;
- failure to seek emergency care;
- treatment obtained from another provider without disclosure;
- the independent acts of a pharmacy with which you contract directly; or
- events outside BeyondBMI’s reasonable control,
except to the extent that BeyondBMI caused or contributed to the loss.
42.4 BeyondBMI is not responsible for a result that was not guaranteed or accepted as a contractual outcome.
42.5 BeyondBMI does not exclude or limit any remedy or responsibility that cannot lawfully be excluded or limited.
42.6 Nothing in these Terms affects your statutory remedies.
43. Member responsibility for misuse
43.1 You may be responsible for reasonable losses directly caused by your deliberate:
- fraud;
- impersonation;
- unlawful use of the Platform;
- infringement of intellectual property;
- misuse of prescriptions;
- unauthorised distribution of medication; or
- serious breach of community confidentiality.
43.2 This clause does not require you to indemnify BeyondBMI for matters caused by BeyondBMI’s negligence, breach of contract or legal non-compliance.
44. Events outside reasonable control
44.1 Neither party is responsible for delay caused by circumstances genuinely outside their reasonable control.
44.2 Such circumstances may include:
- serious infrastructure failure;
- major telecommunications outage;
- cyberattack;
- natural disaster;
- epidemic or pandemic;
- industrial action;
- government restriction;
- national or local medication shortage;
- a change to medication availability, licence, safety advice or supply;
- pharmacy dispensing, collection, delivery or logistics disruption; or
- widespread disruption to third-party systems.
44.3 BeyondBMI will take reasonable steps to:
- minimise disruption;
- communicate material delays;
- protect clinical safety;
- provide alternatives where practicable; and
- resume Services.
44.4 This section does not remove rights you may have where a Service is not ultimately supplied.
45. Notices
45.1 We may send contractual notices to the most recent email address or Platform account associated with your membership.
45.2 You must send cancellation or complaint notices through the routes stated in these Terms, although BeyondBMI will not disregard a clear request merely because it was initially sent through another reasonable communication channel.
45.3 A notice is treated as received:
- when delivered through the Platform;
- when an email enters the recipient’s mail system without an error notice; or
- for a posted notice, two Business Days after posting to the most recent address provided.
45.4 This does not apply where law requires a different method.
46. General provisions
46.1 These Terms do not create an employment, partnership, joint venture or agency relationship between you and BeyondBMI.
46.2 You may not transfer your Product to another person.
46.3 BeyondBMI may transfer its rights and obligations as part of a genuine reorganisation or sale, provided this does not materially reduce your rights.
46.4 If a provision is invalid or unenforceable, the remaining provisions continue to apply.
46.5 A failure or delay in enforcing a right does not waive that right.
46.6 Headings are for convenience and do not affect interpretation.
46.7 These Terms and the documents expressly incorporated into them form the agreement between you and BeyondBMI regarding the Product.
46.8 Nothing in this section excludes representations or rights that cannot lawfully be excluded.
47. Governing law
47.1 These Terms are governed by Irish law.
47.2 The Irish courts have jurisdiction, subject to any mandatory right you may have to bring proceedings elsewhere.
47.3 We encourage Members to use the complaints process before commencing legal proceedings, but doing so is not a mandatory precondition to exercising a legal right.

Clinical ineligibility and refunds
You may cancel or reschedule the Assessment before the appointment in accordance with the notice period.
The €89 Assessment is a healthcare service and does not generally carry a statutory 14-day change-of-mind cancellation right.
Once the specialist assessment has taken place, the €89 fee is not refundable merely because:
no medication is prescribed;
the requested medication is not clinically appropriate;
a particular dose is not prescribed; or
the Member decides not to proceed with treatment.
A refund or free reschedule may be provided where BeyondBMI cancels the appointment and cannot reasonably offer an appropriate replacement.
This does not limit any mandatory right or remedy where the Assessment was not supplied with the legally required level of care, skill or conformity.
No-show rule
A first no-show may receive one free reschedule. The Member must book the replacement within five Business Days of the missed appointment, unless BeyondBMI has no suitable availability. A second no-show requires a new €89 payment.
End of Product
- The Member may be offered the 90-Day Programme.
- The Member is not required to purchase the 90-Day Programme.
- Any ongoing prescribing or support must be separately defined and paid for.
- Access ends after the Product period unless another Product is activated or a clinical transition applies.

Appointment spacing
Appointments should normally take place within seven days of the intended programme milestone. Failure to book within the suggested window may reduce the time available to complete the appointment during the programme.
Payment and withdrawal
The programme is a fixed-term Product. Instalments are payments towards the total programme fee and are not separate monthly memberships.
Where a statutory cancellation right applies, section 27 and Schedule 3 apply. After the applicable cancellation period, payments already made are not refundable merely because the Member withdraws or does not use the programme.
Future installments remain due following withdrawal after the cancellation period.
Programme completion
Where the Member agreed at purchase, the programme is intended to convert to Premium at the end of the programme. The Member will receive a reminder before the first Premium payment and may cancel or request review for Core in accordance with sections 23 and 25.

Important Core conditions
- Core does not include routine one-to-one dietitian, health-coach or psychology appointments.
- Digital education is not a substitute for an individual assessment.

Schedule 2 - Appointment Policy
1. Appointments must be booked through the Platform or another booking route provided by BeyondBMI.
2. Members should book early enough to use an entitlement within the applicable Product period.
3. BeyondBMI may provide reminders as a convenience, but failure to receive a reminder does not remove the obligation to attend.
4. Members must provide 24 hours’ notice to reschedule, unless a Product Schedule states otherwise.
5. A late cancellation may be treated as used or may require a rescheduling fee or new payment.
6. A first no-show may receive one discretionary free reschedule within the same Product period.
7. For the €89 Assessment, the replacement must be booked within five Business Days unless BeyondBMI has no suitable availability.
8. A second €89 Assessment no-show requires a new €89 payment.
9. Repeated no-shows may result in restricted direct booking, a requirement to book through Support, prepayment, suspension or offboarding.
10. A late arrival may shorten the appointment or make a safe consultation impossible; the appointment may still be treated as used.
11. A technical failure caused by BeyondBMI will normally result in restoration or rescheduling of the entitlement.
12. A technical failure caused by the Member may be treated as a late cancellation where the Member did not take reasonable preparation steps.
13. Unused entitlements expire at the end of the applicable period unless the Product Schedule expressly allows carry-forward.
14. Where BeyondBMI cancels, a replacement will be offered within a reasonable period and, where practicable, within five Business Days.
15. Appointments cannot be transferred to another person.
16. An appointment with one professional cannot be exchanged for another professional unless BeyondBMI confirms the change.
17. Additional appointments are subject to clinical need, availability and any stated fee.
Schedule 3 - Cancellation and Refund Policy
A. €89 Assessment
- Cancellation before the assessment
- First no-show: one discretionary free reschedule, subject to Schedule 2.
- Second no-show: a new €89 payment is required.
- Clinically ineligible or no prescription issued: no refund solely for that reason because the professional assessment has been supplied.
- BeyondBMI cancellation: free reschedule or full refund where BeyondBMI cannot reasonably provide the assessment.
- Technical failure: handled under Schedule 2.
B. 90-Day Programme
- Any applicable statutory cancellation right is governed by section 27.
- Where early commencement is requested, a proportionate amount may be payable for Services supplied before cancellation where permitted by law.
- After the applicable statutory cancellation period, payments already made are not refundable merely because the Member withdraws, misses appointments or does not use the programme.
- Future unpaid instalments following withdrawal are still due.
- The upfront discount applies only to an upfront payment and does not create a different statutory cancellation right.
- Where BeyondBMI cannot provide a material element of the programme, it may offer replacement, extension, credit, proportionate refund or another remedy.
C. Premium and Core
- Cancellation requires 30 days’ notice.
- Payments falling due during the notice period remain payable.
- Access continues until the confirmed end date, unless suspended for safety, misconduct or non-payment.
- No partial-month refund is normally provided.
- Unused appointments do not create a cash refund unless BeyondBMI failed to make a material included Service reasonably available.
- Upgrade and downgrade requests are governed by section 25.
- Payment failure is governed by section 22 and Schedule 4.
D. Statutory rights
This Schedule does not limit any mandatory consumer right or remedy.
Schedule 4 - Overdue Payments and Inactive Accounts
A. Failed and overdue payments
1. If a recurring or installment payment fails, the payment provider may retry the payment up to four times within approximately one month.
2. During that period, the account may be marked overdue and access to appointment booking and non-essential Services may be restricted.
3. BeyondBMI may contact the Member through email, SMS, telephone or Platform message to request updated payment information or payment.
4. If payment is recovered, access may be restored after all outstanding amounts have been received and any required system update has completed.
5. BeyondBMI may, at its discretion and where clinically appropriate, provide temporary limited access or account credit to allow a necessary final or follow-up appointment. This does not waive the debt.
6. If payment remains unresolved after the retry and contact process, BeyondBMI may cancel the subscription or access and begin safe offboarding.
7. A Member who deliberately blocks payment, repeatedly cancels and rejoins to obtain periodic appointments, or otherwise attempts to avoid the Product payment structure may be subject to section 26.13.
B. Clinical inactivity - 180 days overdue
1. Where a required follow-up is overdue, BeyondBMI may use its normal engagement process to encourage the Member to book.
2. When the follow-up is 180 days or more overdue, the account may be classified as inactive.
3. BeyondBMI will normally attempt contact by telephone and email over at least three weeks and will issue a final account-closure notice.
4. The final notice will provide a reasonable date by which the Member must book or complete the required follow-up.
5. If the Member does not respond or book by the stated date, the account may be closed at the end of the stated notice period.
6. A former inactive Member may apply to return, but return is subject to section 26 and may require a new assessment, current pricing and progression through earlier programme phases.
